The Ark Studios — Creator Revenue Program Terms

Introduction
The Creator Revenue Program allows eligible Creators to earn money when Viewers pay to watch their published films on The Ark Studios Platform.
By participating in the Creator Revenue Program, you agree to these Creator Revenue Program Terms in addition to our Terms of Use, Privacy Policy, and Community Guidelines.
1) Eligibility
To participate in the Creator Revenue Program, you must:
1.1 Age Requirement: Be at least 18 years old or the age of legal majority in your jurisdiction, whichever is higher.
1.2 Account in Good Standing: Have an active Creator account that complies with our Terms of Use and Community Guidelines.
1.3 Identity Verification (KYC): Complete identity verification and provide tax information as required by law and our payment processors. This may include providing:
- Full legal name
- Date of birth
- Tax identification number (e.g., NIF in Portugal)
- Proof of identity (government-issued ID)
- Bank account or payment method details
1.4 Legal Capacity: Have the legal right to enter into this agreement and receive payments in your jurisdiction.
1.5 Content Compliance: Your content must comply with our Community Guidelines and Terms of Use. Content that violates our policies is not eligible for monetization.
2) How the Revenue Program Works
2.1 Pay-Per-View Model
Viewers pay a one-time fee of $0.99 USD (or local currency equivalent, including applicable VAT) to watch a Creator's published film.
2.2 Revenue Split (Tiered)
Revenue is shared between the Creator and The Ark Studios (operated by Imoportuweb Negócios e Publicidade Lda) according to the following tiered structure based on total views per film:

Example:
If your film reaches 15,000 views at $0.99 per view:
- Views 1–10,000: You earn 70% of $9,900 = $6,930
- Views 10,001–15,000: You earn 65% of $4,950 = $3,217.50
Total Creator Earnings: $10,147.50
2.3 Gross Revenue Basis
Revenue share is calculated on gross viewer payments (before VAT/taxes are deducted). VAT and other taxes are the responsibility of the parties as described in Section 6 below.
2.4 Payment Processing Fees
Payment processor fees (e.g., Stripe, PayPal transaction fees) are deducted before the revenue split is calculated. Typical processor fees are 2.9% + €0.30 per transaction.
2.5 Tips and Donations (Future Feature)
If tipping or donation features are introduced, separate terms will apply. Tips may be subject to different revenue splits or processing fees.
3) Payouts
3.1 Payout Threshold
You must accumulate a minimum of €50.00 in earnings before a payout can be processed.
3.2 Payout Schedule
Payouts are processed monthly, typically within 15 business days after the end of each calendar month, provided you have met the minimum threshold.
3.3 Payment Methods
Payouts are made via:
- Bank transfer (SEPA for EU/EEA Creators)
- PayPal
- Other methods as made available and announced on the Platform
You are responsible for providing accurate and up-to-date payment information.
3.4 Currency
Payouts are made in Euros (EUR) unless otherwise specified. Currency conversion (if applicable) is handled by the payment processor, and conversion fees may apply.
3.5 Failed Payments
If a payout fails due to incorrect payment information, we will notify you. You must update your information within 60 days or the funds may be forfeited.
4) Taxes and Legal Obligations
4.1 Creator Responsibility
You are solely responsible for all taxes, social security contributions, and other legal obligations related to your Creator earnings, including but not limited to:
- Income tax
- VAT (if you are a VAT-registered business)
- Social security contributions (e.g., if you are self-employed in Portugal, you must issue "Recibos Verdes" — green receipts)
4.2 Tax Withholding
In certain jurisdictions, we may be required by law to withhold taxes from your payouts. If applicable, we will notify you and provide documentation.
4.3 Tax Documentation
We may request tax forms or documentation (e.g., W-9, W-8BEN, or equivalent) to comply with local and international tax laws. Failure to provide required documentation may result in suspension of payouts.
4.4 Reporting
We may report your earnings to tax authorities as required by law.
5) Generation Fees (Creator Pays to Generate Films)
5.1 AI Generation Costs
To generate a cinematic film from your uploaded content (photos, text, voice), you will be charged an AI Generation Fee at the time of film creation. This fee covers the cost of:
- AI orchestration (scripting, image processing, video generation)
- Rendering and encoding
- Storage and hosting
5.2 Pricing
Generation fees are displayed at the time of film creation and typically range from €7.00 to €19.00 (plus applicable VAT), depending on:
- Film length (e.g., 2–3 minutes vs. 5–10 minutes)
- Complexity (number of photos, voice recordings, effects)
- AI model usage
5.3 Non-Refundable
Generation fees are non-refundable, even if:
- You choose not to publish the film
- The film is later removed for violating Community Guidelines
- Your account is terminated
5.4 No Earnings Guarantee
Paying a generation fee does not guarantee that your film will earn revenue, attract views, or be featured on the Platform.
6) VAT and Sales Tax
6.1 VAT on Generation Fees
If you are located in the EU/EEA, VAT will be added to generation fees at the applicable rate for your country.
6.2 VAT on Viewer Payments
Viewer payments (pay-per-view) include VAT where required by law. VAT is collected by the Platform and remitted to tax authorities.
6.3 VAT-Registered Creators
If you are a VAT-registered business, you may need to issue invoices for your Creator earnings. Consult a tax professional for guidance.
7) Content Ownership and Monetization Rights
7.1 You Retain Ownership
You retain ownership of your Creator Content, subject to the licenses granted in our Terms of Use.
7.2 Exclusive Monetization (Optional)
We may offer exclusive monetization agreements for select Creators. If you accept such an agreement, you may be required to publish your content exclusively on The Ark Studios for a specified period.
7.3 Demonetization
We reserve the right to demonetize (remove from the Revenue Program) any content that:
- Violates our Community Guidelines or Terms of Use
- Is subject to a valid copyright or rights complaint
- Is deemed unsuitable for monetization at our sole discretion
Demonetized content may remain on the Platform but will not generate revenue.
8) Prohibited Practices
You may not:
- Use bots, click farms, or other artificial means to inflate views or revenue.
- Engage in payment fraud or chargebacks.
- Create multiple accounts to circumvent rules or thresholds.
- Misrepresent your content, identity, or earnings.
Violations may result in immediate termination from the Revenue Program, forfeiture of unpaid earnings, and account termination.
9) Changes to the Revenue Program
We may modify these Creator Revenue Program Terms, including revenue splits, payout thresholds, and eligibility requirements, at any time. Material changes will be communicated via email or Platform notification.
Continued participation in the Revenue Program after changes take effect constitutes acceptance of the updated terms.
10) Termination
10.1 By You
You may leave the Revenue Program at any time by disabling monetization in your Creator Dashboard. You will receive any unpaid earnings above the payout threshold within the normal payout schedule.
10.2 By Us
We may terminate your participation in the Revenue Program if:
- You violate these terms, our Terms of Use, or Community Guidelines
- You fail to complete identity verification or provide required tax documentation
- Your account is suspended or terminated
- We discontinue the Revenue Program (with reasonable notice)
10.3 Effect of Termination
Upon termination:
- You will no longer earn revenue from new views
- Unpaid earnings above the payout threshold will be paid within 60 days
- Earnings below the threshold may be forfeited
11) No Guarantee of Earnings
The Ark Studios does not guarantee any level of views, revenue, or success. Earnings depend on factors including content quality, audience interest, marketing, and Platform algorithms.
12) Limitation of Liability
To the maximum extent permitted by law, Imoportuweb Negócios e Publicidade Lda is not liable for:
- Lost revenue or earnings
- Payment processor errors or delays
- Tax liabilities or penalties
- Changes to the Revenue Program
Our total liability related to the Revenue Program will not exceed €100.00, except where prohibited by law.
